Welcome to Dugoutlive, operated by INTRACXN SPORTS PRIVATE LIMITED (“Dugoutlive”, “we”, “our”, “us”). These Terms govern your use of our mobile application and associated platforms (collectively, the “Service”). By using Dugoutlive, you agree to these Terms and our Privacy Policy.
 

1. Eligibility

• You must be at least 13 years old to use Dugoutlive.

• Users under 18 may only use the Service under the supervision of a parent or legal guardian. Responsibility rests with the user/guardian.
   

2. User Accounts

• You must provide accurate and up-to-date information during registration.

• You are solely responsible for maintaining the confidentiality of your account credentials and all activity under your account.

You are responsible for all actions taken through your account, whether authorized or not.

3. Permissions We Request

Location – To provide personalized content (e.g., local matches, discussions). You can manage permissions in device settings.

Contacts – To help you connect with friends already on Dugoutlive. With your permission:

• Hashed contact data may be temporarily uploaded for matching.

• Raw contact data is neither stored nor shared with any third parties.

• Used only for social features.

 

4. Data We Collect
We may collect:

• Personal data – phone number, email, profile info, posts, chats.

• Technical data – IP address, device info, advertising ID, crash reports.

• Behavioral data – interactions, referrals, ad views/clicks.

We may use third-party vendors for hosting, analytics, and ads. While we require compliance with laws, Dugoutlive shall not be held liable for any data breach, misuse, or unauthorized disclosure caused by third-party service providers.

5. Content & Conduct Guidelines​

Users may not:

• Post illegal, defamatory, obscene, infringing, or harmful content.

• Harass, impersonate, or spread misinformation.

• Interfere with platform operations or use bots.

Additional Prohibited Content:

• Hate speech, religiously offensive material, or incitement to violence.

• Political campaigning or election manipulation.

• Betting, gambling, or fantasy contests not legally permitted.

• AI-generated deepfakes or manipulated media.

Community Moderation:

• Dugoutlive may review, restrict, or remove content at its discretion.

• Dugoutlive has no obligation to monitor all user activity.

• Moderation efforts are conducted on a best-effort basis and may not be immediate. Dugoutlive makes no warranties that all harmful, offensive, or unlawful content will be detected, removed, or prevented.

• Users acknowledge that content may remain visible temporarily, and Dugoutlive shall not be held liable for delays or failures in moderation. Dugoutlive retains absolute discretion to remove, retain, or reinstate any content and is under no obligation to explain or justify such actions to users.

 

6. User-Generated Content (UGC)

• Ownership – You retain rights to your content.
   

• License to Dugoutlive – By posting, you grant Dugoutlive a non-exclusive, worldwide, royalty-free license to modify, adapt, crop, reformat, translate, or otherwise use the content in ways necessary for technical delivery, content moderation, or promotion of the Service. ​​This license survives account deletion and remains valid as long as the content is hosted or repurposed by Dugoutlive.
   

• User Warranties – You represent and warrant that your content does not violate laws or third-party rights. You warrant that you have all necessary rights and licenses to share such content.
   

• No Publisher Liability – Dugoutlive is not the author, editor, or publisher of user content and shall not be held liable for its accuracy or legality.
   

• User Content Indemnity – You agree to indemnify and hold harmless Dugoutlive, its parent company, directors, promoters, founders, officers, employees, and affiliates from any claims, damages, or losses arising from your content or conduct.
   

7. Intermediary Disclaimer
Dugoutlive acts only as a passive intermediary under Section 79 of the IT Act, 2000.

• We do not initiate, select, or modify user content.

• We have no duty to pre-screen content.

• Users are solely responsible for their content and actions.
  
  Dugoutlive will comply with lawful takedown orders and directions from government or law enforcement.
  Nothing in these Terms shall be construed to impose liability on Dugoutlive for any third-party content under applicable law.
   

8. Referral Program​

Users may invite friends to join Dugoutlive. Referral data (phone/email) is used solely to process referrals. Bonuses may be revoked for spam, fraud, or abuse.
 

9. Encrypted Chats

• Private chats are end-to-end encrypted.

• Dugoutlive cannot access message content.

• Metadata (timestamps, sender/receiver) may be stored for security, abuse prevention, and legal compliance.

 

10. Copyright & Intellectual Property

If you believe your IP is infringed:

• Email: admin@dugoutlive.com

• Include description, proof of ownership, and link/screenshot.

Takedown Policy:

• Dugoutlive will act on valid notices within 36 hours in good faith.

• Dugoutlive is not liable for delays if information provided is incomplete or disputed.

• Repeat infringers may be suspended or terminated.

• All disputes are between the complainant and the user. Dugoutlive is not a mediator.

Dugoutlive shall not be held liable for content retained, delayed, or reinstated after a takedown request if such action was taken in good faith or based on incomplete/conflicting claims.
 

11. Limitation of Liability

To the maximum extent permitted by law, Dugoutlive, its directors, promoters, founders, officers, employees, and agents shall not be liable for any:

• Direct, indirect, incidental, or consequential damages.

• Loss of profits, goodwill, data, or business opportunities.

• Unauthorized access, hacking, downtime, or data loss.

• Disputes or interactions between users.

• Reliance on user content, ads, or third-party services.

• The Service is provided “as is” and “as available,” without warranties of any kind, express or implied

• This limitation applies even if Dugoutlive has been advised of the possibility of such damages.

Use of Dugoutlive is entirely at your own risk.
 

12. Protection of Officers & Shareholders
No director, promoter, founder, officer, or shareholder of Dugoutlive shall be personally liable for any claims, liabilities, damages, or disputes arising from or related to the Service. All claims shall lie solely against Dugoutlive as a corporate entity.

13. Cookies & Tracking

We use cookies, SDKs, and device identifiers for analytics, personalization, ads, and platform security. You may disable tracking in device settings.

14. Advertising & Analytics

We use Google AdMob and other advertising partners to display ads within Dugoutlive.These services may collect and use certain types of data, including:

• Your device’s Advertising ID

• Cookies or similar tracking technologies

• Device and usage data (such as app interactions, ad views, and clicks)

This information helps us:

• Deliver personalized or non-personalized ads

• Measure ad performance

• Improve the relevance of ads you see

You can manage or opt out of personalized advertising at any time via your device settings:

• Android: Settings > Google > Ads > Opt out of Ads Personalization

• iOS: Settings > Privacy > Apple Advertising > Limit Ad Tracking

15. Third-Party Services
We rely on vendors for hosting, messaging, analytics, and advertising.

• Vendors must comply with applicable privacy laws.

• Dugoutlive is not liable for independent actions or failures of third-party vendors.

16. Data Privacy & DPDP Act Compliance

• Users consent to Dugoutlive collecting, storing, and processing their data in accordance with the Digital Personal Data Protection Act, 2023.

• Users consent to sharing of data with third-party vendors strictly for service operation.

• Dugoutlive implements reasonable security safeguards but is not responsible for breaches caused by third parties beyond its control.

• Complaints acknowledged within 24 hours.

• Urgent takedowns resolved within 36 hours.

• All other complaints resolved within 15 days.

• Users can also submit data-related concerns about advertising to our Grievance Officer.
   

18. Termination

We may suspend or terminate accounts for:

• Violations of law or these Terms.

• Users may delete accounts at any time.
   

19. Dispute Resolution & Jurisdiction

• All disputes shall be resolved by arbitration under the Arbitration and Conciliation Act, 1996.

• Seat: Hyderabad, Telangana.

• Language: English.

• Courts in Hyderabad have exclusive jurisdiction for enforcement.

• Arbitration is the exclusive remedy. Users waive the right to pursue complaints in consumer courts, criminal complaints against Dugout officers, or class actions.
   

20. Changes to These Terms

We may update this document periodically. Where required by law, we will notify users of material changes to these Terms. Continued use of the Service constitutes acceptance of changes.
